Get Medical Attention! Obtain the very best medical care that you can through your own doctors.

Report the accident to your employment    supervisor immediately. You will be required to complete and sign an Accident Report. READ THE QUESTIONS CAREFULLY BEFORE SIGNING. There may be tricky questions with legalese designed to mitigate the railroads responsibility. KEEP A COPY.

Report the accident to your Union Rep as soon as possible.

Make a detailed personal report for your future use.

Take Photographs of your condition. (Keep the negatives)

Get the names of all witnesses and everyone who knew of the hazardous condition or defective equipment.

Determine ALL factors of railroad fault.

Keep track of time missed.

Apply to the Railroad Retirement Board for sickness benefits.

If you have a disability insurance policy, contact the insurance company to begin receiving payments.

Know your rights

 

Do not allow company officials to stay in the treating room. Your are entitled to doctor-patient privilege. Something may be said in the treating room that may be used against you later.

 

Do not sign a medical release of information to the railroad without first getting legal advice.

Do not sign any other statement than the Accident Report. You are not required to make any other statement - the accident report is the only thing you are required to complete.

Do not give a recorded or written statement to a claim agent or anyone else until you have had an opportunity to discuss the matter with your FELA lawyer or union officials.

Make no oral statements - refer everyone to your written statement contained in the Accident Report.

Do not answer "No" to questions on the Accident Report that deal with defects in equipment. Since you may not be in a position to know if a defect existed - answer "presently unknown" instead. Competent investigators will determine defect later
